Product Description
International Copyright Law and Policy deals comprehensively with the major treaties and conventions covering the law of international copyright and neighboring rights. It explains the complex legal, economic and political background to the treaties and their contents, and how they inter-relate. There is also practical commercial discussion of how copyright and neighboring rights are treated in international trade measures such as GATT, WTO, NAFTA, and bilateral and unilateral treaties, with a section devoted to how unilateral trade measures are applied by the USA in particular. There is also some discussion of how international copyright law and neighboring rights may develop in the future.

Product Description
The questions relating to copyright belong naturally to the sphere of political economy. They have to do with the laws governing production, and with the principles regulating supply and demand; and they are directly dependent upon a due determining of the proper functions of legislation, and of the relations which legislation, having for its end the welfare of the community as a whole, ought to bear towards production and trade.

As students of economic science, we recognize the fact that, in all its phases, it is in reality based upon two or three very simple propositions, such as:

Two plus two make four.

Two from one you can’t.

That which a man has created by his own labor is his own, to do what he will with, subject only to his proportionate contribution to the cost of carrying on the organization of the community under the protection of which his labor has been accomplished, and to the single limitation that the results of his labor shall not be used to the detriment of his fellow-men.

It is not in the power of legislators to make or to modify the laws of trade; it is their business to act in accordance with these laws.

Economic science is, then, but the systematizing, on the basis of a few generally accepted principles, of the relations of men as regards their labor and the results of their labor, namely, their property. There is therefore an essential connection between the systems governing all these relations, however varied they may be. Soundness of thought in regard to one group of them leads to soundness of thought about the others.

Product Description
In 1998, copyright lobbyists succeeded in persuading Congress to enact laws greatly expanding copyright owners’ control over individuals’ private uses of their works. The efforts to enforce these new rights have resulted in highly publicized legal battles between established media, and new upstarts. In this enlightening and well-argued book, law professor Jessica Litman questions whether copyright laws crafted by lawyers and their lobbyists really make sense for the vast majority of us. Should every interaction between ordinary consumers and copyright-protected works be restricted by law? Is it practical to enforce such laws, or expect consumers to obey them? What are the effects of such laws on the exchange of information in a free society? Litman’s critique exposes the 1998 copyright law as an incoherent patchwork. She argues for reforms that reflect common sense and the way people actually behave in their daily digital interactions. This paperback edition includes an afterword that comments on recent developments, such as the end of the Napster story, the rise of peer-to-peer file sharing, the escalation of a full-fledged copyright war, the filing of lawsuits against thousands of individuals, and the June 2005 Supreme Court decision in the Grokster case.

Product Description
Providing a vital economic incentive for much of society’s music, art, and literature, copyright is widely considered “the engine of free expression”–but it is also used to stifle news reporting, political commentary, historical scholarship, and even artistic expression. In Copyright’s Paradox, Neil Weinstock Netanel explores the tensions between copyright law and free speech, revealing the unacceptable burdens on expression that copyright can impose. Tracing the conflict across both traditional and digital media, Netanel examines the remix and copying culture at the heart of current controversies related to the Google Book Search litigation, YouTube and MySpace, hip-hop music, and digital sampling. The author juxtaposes the dramatic expansion of copyright holders’ proprietary control against the individual’s newly found ability to digitally cut, paste, edit, remix, and distribute sound recordings, movies, TV programs, graphics, and texts the world over. He tests whether, in light of these and other developments, copyright still serves as a vital engine of free expression and assesses how copyright does–and does not–burden free speech. Taking First Amendment values as his lodestar, Netanel offers a crucial, timely call to redefine the limits of copyright so it can most effectively promote robust debate and expressive diversity–and he presents a definitive blueprint for how this can be accomplished.

“Copyright’s Paradox fluently examines an array of recent copyright controversies, highlighting the problematic free speech implications of an ever-expanding copyright regime…. Netanel’s incisive examination of his subject through a First Amendment lens helps illuminate some of the issue’s critical cultural and constitutional dimensions.”–Harvard Law Review

“Neil Netanel is rightly hailed as one of the most important writers and thinkers in the field… his latest book, Copyright’s Paradox, cements that reputation… Best of all, Copyright’s Paradox offers solutions, a set of simple legislative recommendations that are both realistic and promising-solutions that will end the copyright wars without destroying the public interest or the fortunes of artists.”–BoingBoing.net

“Timely and topical. . . Netanel’s well-researched, informative and eminently readable book is a thoughtful and important contribution to the debate, and should be read by those seeking practical solutions to a problem that will not go away with wishful thinking.”–New Jersey Lawyer

“Netanel makes an original and creative argument that copyright is in the end about speechEL. Copyright’s Paradox should be on the list of required reading for anyone concerned with the inner workings of the copyright system, and those interested in issues of institutional or regulatory design as they relate to public policy goals.”
–Shyam Balganesh, Yale Law Journal

The NCCI sued former VPs Michael Camilleri and Robert Hilton, Industrial Data Resources, and the Adorno and Zeder law firm for violating statistical manual copyrights which had been filed in 1979.
